But can you?**I would argue these covers are parodies of the actual text cover with the TM left there to drive the connection. Can the singular box replacing %22Amatterofdesign%22, ON ITS OWN, be a defensible trademark? I've often found you cannot own a common shape unless in context with something proprietary. **Here's an example: check out the Human Rights Campaign equality logo: http://www.hrc.org/**Immediately recognizable and most often used as a stand alone graphic. But it only has a mark (in this case a registration mark) when coupled with its text. Do they own a trademark on the graphic itself? Can they own a common %22equal%22 sign? Or do the colors, layout and proportions in relation to the box make it trademarkable. I dunno.
